These changes will significantly impact the reporting, investigation, assessment, prosecution and judicial handling of child abuse and neglect cases.<\/p>\n<p>The new laws will expand and further define mandatory reporters and the reporting process, increase penalties for those mandated to report suspected child abuse who fail to do so, and provide protections from employment discrimination for filing a good faith report of child abuse.<\/p>\n<h3><b>Who are Mandatory Reporters? <\/b><\/h3>\n<ul style=\"list-style-type: disc;\">\n<li style=\"list-style-type: none;\">\n<ul style=\"list-style-type: disc;\">\n<li>Any school employee coming into \u201cdirect contact with children.\u201d<\/li>\n<li>Any individual providing a \u201cprogram, activity, or service sponsored by a school\u201d (e.g., independent contractors, volunteers).<\/li>\n<li>Any individual providing effort (paid or unpaid) for a regularly\u2010scheduled program, activity, or service not necessarily sponsored by a school where individuals \u201caccept responsibility for a child\u201d (e.g., Girl and Boy Scout programs, religious camp or youth group programs).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><b>What Constitutes Child Abuse?<\/b><\/h3>\n<p>Click on the link below.<\/p>\n<p><a href=\"https:\/\/www.psea.org\/uploadedFiles\/PupilServices\/NewChildAbuseLaw-ReportingReqs.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">New Child Abuse Law Reporting Requirements<\/a><\/p>\n<h3><b> To Report Child Abuse Call ChildLine 800-932-0313:<\/b><\/h3>\n<p>The Intake Unit is available 24 hours to receive reports of suspected child abuse.<br \/>\nClick on the link below.<\/p>\n<p><a href=\"https:\/\/www.dhs.pa.gov\/about\/Fraud-And-Abuse\/Pages\/default.aspx\">Report Child Abuse<\/a><\/p>\n<h3><b> PMTA POLICY REGARDING EVENTS <\/b><\/h3>\n<ul style=\"list-style-type: disc;\">\n<li style=\"list-style-type: none;\">\n<ul style=\"list-style-type: disc;\">\n<li style=\"list-style-type: none;\">\n<ol>\n<li>Minor students (under 18) participating in PMTA events must be accompanied by a parent or other responsible adult designated by the parent.<\/li>\n<li>PMTA members will follow the criminal background check policy that the host institution (where the event is held) has in place.<\/li>\n<li>In the event that the host institution does not have a policy in place, PMTA members should adhere to the following guidelines:<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h4>Any adjudication under PMTA&#8217;s auspices should take place under one of these two requirements:<\/h4>\n<ul style=\"list-style-type: disc;\">\n<li style=\"list-style-type: none;\">\n<ul style=\"list-style-type: disc;\">\n<li style=\"list-style-type: none;\">\n<ol>\n<li>An adjudicator who has passed criminal background check (FBI) and child abuse clearances\u00a0<span class=\"m_4684765047828896557gmail-aBn\"><span class=\"m_4684765047828896557gmail-aQJ\"><span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1276630592\"><span class=\"aQJ\">within 5 years<\/span><\/span><\/span><\/span>; OR<\/li>\n<li>A parent of the student being adjudicated or a monitor is in the room so that there is no one-on-one contact.<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><b>Required Clearances<\/b><\/h3>\n<p><a href=\"https:\/\/www.compass.state.pa.us\/cwis\/public\/home\" target=\"_blank\" rel=\"noopener noreferrer\">Pennsylvania Child Abuse History Clearance<\/a><br \/>\n<a href=\"https:\/\/epatch.state.pa.us\/Home.jsp\" target=\"_blank\" rel=\"noopener noreferrer\" class=\"broken_link\">Pennsylvania State Police Criminal Record Check<\/a><br \/>\n<a href=\"https:\/\/www.fbi.gov\/services\/cjis\/identity-history-summary-checks\" class=\"broken_link\">Federal Bureau of Investigation Criminal Background Check<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pennsylvania Music Teachers Association Clearance Policy Revised July 2016 (CLICK HERE to download this information.)
